Terms & Conditions
River Forest Community Association Clubhouse is within the River Forest neighborhood and therefore quiet time will be enforced and the doors will be locked promptly at 10:00pm.
RENTAL FEE
Lessee shall pay to River Forest Community Association as a rental fee for the use by Lessee of the Clubhouse, the sum of $100 per hour (the "Rental Fee”).
Lessee shall deposit the sum of $250.00 with River Forest Community Association upon the execution of the Agreement. No portion of this deposit shall be applied by River Forest Community Association to the Rental Fee. The Rental Fee shall be paid in full by Lessee at least 10 days prior to the day of the Event. $150 of the deposit will be returned to the Lessee if the club house is left in pre-event condition. The determination of the condition is at the sole discretion of the River Forest Community Association . River Forest Community Association shall provide Lessee with details outlining these expectation.
River Forest Community members receive a discount if they have 2 current consecutive years of membership in River Forest Community Association, (purchase may be necessary).
INSURANCE
Lessee agrees that it shall, at its sole cost and expense, procure and maintain a policy of commercial general liability insurance (including contractual liability) in an amount not less than $1,000,000.00 per occurrence, $2,000,000.00 in the annual aggregate. Such insurance policies shall be carried with companies licensed to do business in the state of Florida, reasonably satisfactory to River Forest Community Association and shall be non-cancelable and not subject to material change except after thirty (30) days written notice to River Forest Community Association . Lessee shall deliver to River Forest Community Association duly executed certificates of insurance within 10 days of signed agreement. River Forest Community Association shall not at any time be liable for damage or injury to persons or property in or upon the Clubhouse.
River Forest Community Association must be named as “additional named insured” on the Certificate of Insurance, and the Certificate must be delivered to River Forest Community Association prior to Applicant’s within 10 days of signed agreement
All vendors shall also maintain liability insurance and provide River Forest Community Association a copy of policy prior to the use of the property. This is the responsibility of the Lessee. If the vendor is unable or unwilling to provide this information, the deposit and/or rental fee will be forfeited and the agreement terminated.
INDEMNIFICATION
Lessee shall indemnify, defend and save harmless River Forest Community Association , its officers, agents and employees from and against any and all loss, cost (including attorneys' fees), damage, expense and liability (including statutory liability and liability under workers' compensation laws) in connection with claims, judgments, damages, penalties, fines, liabilities, losses, suits, administrative proceedings, arising out of any act or neglect by Lessee, its agents, employees, contractors, Lessees, invitees, representatives, vendors in, on or about the River Forest Community Clubhouse and property. This indemnity shall survive the termination of the Agreement. Lessee hereby releases River Forest Community Association from any and all liability or responsibility to Lessee or anyone claiming through or under Lessee by way of subrogation or otherwise for any loss or damage to equipment or property of Lessee covered by any insurance then in force.
ASSIGNMENT AND SUB-LICENSING
Lessee shall not assign any interest in the Agreement or otherwise transfer or sublicense the Clubhouse or any part thereof or permit the use of the Clubhouse to any party other than Lessee.
TERMINATION
River Forest Community Association may terminate this Agreement based upon any one or more of the following events:
A. Failure of Lessee to pay the Rental Fee or any other charges due hereunder when the same is due;
B. Lessee fails to perform any of its covenants hereunder. In any of the aforesaid events, and in addition to any and all rights and remedies available to River Forest Community Association by law or in equity, River Forest Community Association may, with or without further notice, forthwith terminate the Agreement and expel and remove Lessee, or any other person or persons in occupancy from the Clubhouse, together with their goods and chattels, using such force as may be necessary in the judgment of River Forest Community Association or its agents in so doing, without evidence of notice or resort to legal process or becoming liable for any loss of damage which may be occasioned thereby, and repossess and enjoy said Clubhouse, and in addition to any other remedy it may have, River Forest Community Association may recover from Lessee all damages it may incur by reason of such breach by Lessee.
INTERFERENCE
Lessee shall use the Clubhouse in a manner which shall not cause interference with the use or occupancy of the other portions of the Building by River Forest Community Association or others in any way. Lessee's use hereunder will be done in such a manner so as not to interfere with or impose any additional expense upon River Forest Community Association in maintaining the Building.
RESTORATION
If any damage occurs to the River Forest Community Clubhouse and/or property, or if any repairs or replacements need to be made to the Clubhouse and/or property as a result of Lessee's exercise of its rights under this License, Lessee shall pay River Forest Community Association for any such damage, repairs, or replacements upon demand by River Forest Community Association .
CANCELLATION
Lessee may cancel this Agreement at any time up to 30 days prior to the Event Date by providing written notice of such election to River Forest Community Association , at no cost to Lessee. If Lessee shall elect to cancel this agreement between 29 and 0 days prior to the Event Date, Lessee will be charged 100% of the deposit.
PAYMENT AND METHOD
Payment is to be made by cash or check. 100% of deposit is due upon completion of the signed agreement. Remaining balance is due at least 10 days prior to the day of the Event
GUIDELINES FOR Association Clubhouse RENTAL AND USE
Alcohol is permitted only with a licensed and insured bartender service, unless special pre-event permission has been granted in writing by President or Vice President of River Forest Community Association board. See INSURANCE for additional details. Alcoholic beverages found on the property without proper approval or approved vender will result in IMMEDIATE TERMINATION OF THE AGREEMENT and event will be canceled regardless of if the event has begun or not. Lessee will not be reimbursed any funds.
Smoking is not permitted inside the Association Clubhouse or within 50 feet of the Association Clubhouse’s entrances.
The community Association Clubhouse is available for rent between the hours of 8 a.m. and 10 p.m.
The maximum occupancy is 100 people.
You must meet with staff at the Association Clubhouse the week of your event to conduct the pre-inspection and walkthrough. Staff will call you to set up your meeting time.
The kitchen is equipped with a stove, oven, sink, refrigerator, ice machine, and a microwave.
Tables, chairs, stemware, table setting and linens are provided for you convenance.
Candles, bubble machines and smoke/fog machines are not permitted for use in the Association Clubhouses. Smoke and open flames will set off the fire alarm.
Do NOT use staples, screws, duct tape and tacks on the tables, on site interior / exterior, fences, and trees. Failure to do so may result in the loss of your deposit. Confetti and glitter are not permitted onsite.
The A/C is programmed to run in the building. Please leave the fan on “AUTO” so that the thermostat can do its job. If you want to change the A/C please use the arrow down button. Please do not reprogram. When exiting the building please insure that the temperature is set to 80.
Lessee agrees to accept the Clubhouse in its "as-is" condition "with all faults".
Dona rooms are included for weddings only, non-sleeping Bride / Groom room. Overnight not available. Rooms must be vacated no later than 10:00pm.
No pets or animals of any kind allowed in or on Clubhouse property.
No bounce house, no tree climbing, no swimming, no trampolines, no fireworks, no firearms, and no throwing items in the river/water.
Lessee recognizes that the water front provides inherent risk and dangers, including, drowning, snakes and alligator injuries, fall hazards, River Forest Community Association is not responsible for and will not be held liable for injuries or death which may result from activities on River Forest Community Association Clubhouse and/or property.
EMERGENCY INFORMATION
The Clubhouse does not have a phone available; please ensure you have access to a cell phone.
Call 911 for ambulance, fire, or police emergencies using your cell phone.
CLOSING THE CLUBHOUSE AFTER YOUR RENTAL
Remove any tape and decorations from the tables, walls, and ceiling.
Clean up any food, drink, or other spills on the tables, counters, sinks, and/or floors. A push broom, dustpan, wet mop, mop bucket, paper towels, and cleaning spray are available for you to use.
Return all tables and chairs neatly to their original locations.
Sweep the floors and spot mop prior to leaving.
Empty all inside trash cans and put the garbage in the dumpster outside. If there is an excess of trash that will not fit in the dumpster you must put in plastic garage bags.
Clean any stemware, table setting, cooking equipment, cookware and return to original location.
Any linens must be returned cleaned within 5 days of retail in order to receive deposit back.
Check the Clubhouse to ensure nothing has been left behind.
Check to make sure that all exterior doors are closed, locked, and secure.
Clean up all outside grounds used during the event.
All remotes and other AV equipment must be returned in good working order.
GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any legal actions, claims or demands shall be handled in a court of competent jurisdiction within the State of Florida.
